Satellite Beach Police Officer Unlawfully Arrested Woman Violating Her Free Speech, ACLU Sues (09/29/2008)
SATELLITE BEACH, Fla. – The American Civil Liberties Union of Florida today announced it filed suit on behalf of Kimberly Bock, who was unlawfully arrested and prosecuted for using profanity in the presence of two Satellite Beach police officers. The lawsuit was filed in the U.S. District Court for the Middle District of Florida on Friday, September 26. The judge hearing the criminal case against her threw it out of court, noting that the law is clear: using profanity alone cannot be cause for arrest.

Federal Judge Strikes Down Orlando Homeless Feeding Ban (09/26/2008)
ORLANDO, Fla. – The American Civil Liberties Union of Florida won an overwhelming victory today in First Vagabonds Church of God vs. City of Orlando, the highly publicized "homeless feeding" case in Orlando. The 14-page opinion issued by Federal Judge Gregory A. Presnell hinged on the plaintiffs' right to Free Exercise of Religion and Freedom of Speech.

Statewide Ad Campaign Targets Re-enfranchised Voters (09/15/2008)
MIAMI – The Florida Rights Restoration Coalition (FRRC) and the American Civil Liberties Union (ACLU) of Florida today launched a voter registration outreach campaign targeting people with past felony convictions whose rights have been restored, as well as those who are unsure of their civil rights status. The campaign comes on the heels of seven years of work educating the public about rights restoration and attempts to get the word out to re-enfranchised voters – a job that FRRC says the State of Florida has failed to take the lead on.

ACLU Files Lawsuit To Protect Religious Freedom Of Florida High School Students (08/27/2008)
PENSACOLA, FL – Santa Rosa County school officials are using their governmental positions to promote their personal religious beliefs in public schools, according to a lawsuit filed today on behalf of two Pace High School students by the American Civil Liberties Union of Florida and the national ACLU.

Okeechobee, FL High School Gay-Straight Alliance Wins Groundbreaking Federal Lawsuit (07/30/2008)
OKEECHOBEE, FL – A Florida federal court today ruled that school officials in Okeechobee, Florida must allow a gay-straight alliance (GSA) club to meet on campus. In a precedent setting order arising in a lawsuit brought by the American Civil Liberties Union, Judge K. Michael Moore upheld his earlier ruling that GSAs do not interfere with abstinence-only education and, in a legal first, held that schools must provide for the well-being of gay students.

Palm Beach Student's Rights Upheld by 11th Circuit Court of Appeals in Pledge of Allegiance Case (07/23/2008)
WEST PALM BEACH, Fla. – The American Civil Liberties Union of Florida today claimed victory in its federal lawsuit, Cameron Frazier v. Cynthia Alexandre et al, as the 11th Circuit Court of Appeals upheld an earlier District Court decision preventing a Palm Beach County school from requiring a student from standing to recite the Pledge of Allegiance. The court left the decision that Cameron Frazier's rights were violated untouched while leaving the door open for additional lawsuits by refusing to rule on the statute as it applies across the board to all students.

Lawsuit Aims To Remove Amendments 7 And 9 From Florida's November Ballot (06/13/2008)
TALLAHASSEE, Fla. - A group of concerned organizations, including The American Civil Liberties Union (ACLU) and the ACLU of Florida, filed a lawsuit today in the Circuit Court of the Second Judicial Court in and for Leon County on behalf of a group of Floridians representing parents of public school students, teachers, administrators and concerned citizens. The goal of the lawsuit is to prevent Amendments 7 and 9 from reaching the November ballot.

New Online Search Tool Gives Ex-Offenders Ability To Search Clemency Status (05/13/2008)
TALLAHASSEE, Fla. – Today, the ACLU of Florida and the Florida Rights Restoration Coalition launched an online search tool that will enable people with past felony convictions in Florida to search state records and find out if their civil rights, including their voting rights, have been restored. The online search tool is available on both Web sites: www.restorerights.org and www.aclufl.org.

ACLU Sues City of Greenacres on Behalf of Disabled Resident (04/30/2008)
WEST PALM BEACH, Fla. - The American Civil Liberties Union of Florida filed a lawsuit today against the City of Greenacres in the Fifteenth Judicial Circuit, State Court. Filed on behalf of Peter W. Ballance, 63, the lawsuit alleges that the City denied him reasonable accommodation services and treated him differently due to communication issues associated with Asperger's Syndrome, from which Ballance suffers.

Sex Segregation In Florida's Public Schools A Bad Move, Says ACLU (04/10/2008)
TALLAHASSEE, Fla. - The American Civil Liberties Union of Florida sent a letter to Governor Charlie Crist yesterday strongly urging that he veto the Legislature's flawed plan, which would open the door to segregating students by sex in Florida's public schools.

Design Should Not Be Taught in Florida’s Public School Science Classrooms (03/12/2008)
TALLAHASSEE, Fla. – The American Civil Liberties Union of Florida today spoke out against Florida Senate Bill 2692, following a news conference held by TV personality Ben Stein. The following can be attributed to Howard Simon, Executive Director of the ACLU of Florida: “The presumption of this bill is that all you have to do to teach something in a science class is to call it science. Simply saying something is science does not make it so and calling Intelligent Design science, does not make is science. Intelligent Design relies on the assertion that there is a supernatural creator, which inherently precludes it from being scientific, as the ACLU proved in our landmark case in Dover, PA.

ACLU to Florida Board of Education: Don’t Allow Religious Groups to Force Their Beliefs Into Science Classes (12/18/2007)
TALLAHASSEE, Fla. – The American Civil Liberties Union of Florida sent a letter to the Florida Board of Education (FBOE) outlining the potential legal risks of adopting a science curriculum that includes particular religious groups’ beliefs about the origins of the universe.

HOLLYWOOD, FL - The American Civil Liberties Union of Florida praises the Broward County School Board for taking the appropriate steps to ensure adequate oversight for the new school, Ben Gamla Charter School in Hollywood, FL. Dubbed "America's First English-Hebrew Charter School," Ben Gamla has been in the hot seat due to concerns about potential First Amendment violations regarding the curriculum, which includes Hebrew language.

ACLU of Florida Speaks Out Against Free Speech Violation, Threatens Litigation (08/30/2007)
ORLANDO - The American Civil Liberties Union of Florida sent a letter today on behalf of Bryan J. and Leilani J. Orr, whose constitutionally protected free speech right to display political signs in their front yard was recently suppressed by the City of Clermont, FL, located in Lake County. Code Enforcement Officer Betty McMinamen demanded that the Orrs remove the sign from their yard in an August 23 letter citing a City code requiring a $50.00 deposit in order to display a political sign.

ACLU of Florida Lauds School Board's Vote to Revise Sex Education Curriculum (08/15/2007)
MELBOURNE, FL- The American Civil Liberties Union of Florida today praised the efforts of Brevard County Superintendent Richard A. DiPatri whose recommended sex education curriculum revisions were approved by a 3-2 vote at last night's school board meeting. The Superintendent's revisions were supported by the votes of school board members Barbara Murray, Larry E. Hughes, and Chairman Robert Jordan.

ACLU Joins National Gay Rights Groups Calling on Fort Lauderdale City Commission to Condemn Mayor's Anti-Gay Remarks (08/02/2007)
FORT LAUDERDALE, FL -- The American Civil Liberties Union of Florida today announced it has joined forces with the National Gay and Lesbian Task Force in an open letter calling on the Ft. Lauderdale City Commission to promptly pass a resolution condemning Mayor Naugle's recent series of hostile remarks about the City's gay community. In recent years the City has become a prime vacation venue for gay tourists.

ACLU Veteran Beth Wilson Appointed First-Ever Deputy Director of the ACLU of Florida (07/17/2007)
MIAMI - The American Civil Liberties Union of Florida today announced that Beth Wilson, the current Executive Director of the ACLU of Kentucky, will join the ACLU of Florida as Deputy Director effective September, 2007. The newly created position of Deputy Director at one of the nation's largest ACLU affiliates was created to steer the organization's multi-year growth plan and further advance civil liberties in the Sunshine State by expanding staff, volunteers and infrastructure.

City of Fort Lauderdale Settles After Unconstitutional Ordinance Banning Free Speech is Struck Down (05/16/2007)
FORT LAUDERDALE, FL - The American Civil Liberties Union of Florida's Broward Chapter welcomed Federal Judge K. Michael Moore's ruling in favor of the ACLU and other coalition partners on Fort Lauderdale's unconstitutional ordinance that attempted to stifle free speech. The May 14, 2007 order, which grants the parties settlement, follows an order directing the City to no longer enforce the ordinance.

ACLU of Florida Announces Participation in Multi-State Action on Abstinence-Only-Until-Marriage Curricula (05/10/2007)
MIAMI -- The American Civil Liberties Union of Florida today announced its participation in a multi-state action calling on the federal government to fix medical inaccuracies in federally funded abstinence-only-until-marriage curricula. Eleven ACLU affiliates sent letters to the Department of Health and Human Services (HHS) alerting the agency to problematic curricula in their states and asking HHS to take steps to remedy the situation.

NEW YORK – The American Civil Liberties Union today announced a multi-state action calling on the federal government to fix medical inaccuracies in federally funded abstinence-only-until-marriage curricula. ACLU Applauds Florida Legislature for Scrapping Flawed Voting Machines (05/03/2007)
TALLAHASSEE, FL - The American Civil Liberties Union applauded today’s 118-0 vote by the Florida House of Representatives to pass a bill requiring paper ballot voting technology in all counties before the 2008 primaries and general election. The House vote comes shortly after the Florida Senate approved a similar measure.

Supreme Court Considers Broad Attack on Civil Rights Attorneys' Fees (04/17/2007)
WASHINGTON - The Supreme Court today heard arguments in a case that may determine whether a plaintiff who successfully obtains a preliminary injunction is ever entitled to recovery of attorneys’ fees. The case, Sole v. Wyner, stems from a free speech lawsuit brought by the American Civil Liberties Union of Florida.

Federal Judge Rules Okeechobee, FL Students Can Form Gay-Straight Alliance Club (04/06/2007)
OKEECHOBEE, FL - The American Civil Liberties Union of Florida today welcomed a district court decision ordering Okeechobee High School to officially recognize and allow equal access to the Okeechobee High School Gay Straight Alliance.

Florida Clemency Reform Not All It’s Cracked Up to Be, Says ACLU (04/05/2007)
TALLAHASSEE, FL - The American Civil Liberties Union expressed disappointment with today’s announcement by Governor Charlie Crist and the Board of Executive Clemency regarding Florida's new rules for restoration of civil and voting rights. Although this first step toward comprehensive reform represents incremental progress, said the ACLU, the new rules fall far short of fixing Florida’s civil and voting rights crisis.

ACLU of Florida Applauds New Wal-Mart Policy Requiring its Pharmacies to Fill Valid Requests for Birth Control (04/04/2007)
MIAMI – The American Civil Liberties Union of Florida today applauded a decision by Wal-Mart Stores, Inc., requiring the national retail chain’s pharmacies to satisfy valid requests for birth control, including emergency contraception (EC). The policy shift came in response to Planned Parenthood Federation of America’s “Fill My Pills Now!” campaign, in which the ACLU of Florida participated.

ACLU of Florida Raises Concerns Over Flaws in Civil Rights Restoration Plan (04/02/2007)
TALLAHASSEE, FL – The American Civil Liberties Union of Florida today applauded Governor Charlie Crist’s announcement that he and the cabinet (sitting as the Board of Executive Clemency) will address civil rights restoration for ex-offenders through clemency reform this week. However, the ACLU warned that any plan that has exclusions or requires restitution to be paid before civil rights can be restored would be unfair.

TALLAHASSEE, FL - Sarasota County voters contesting the 13th Congressional District election filed court papers late yesterday charging that Florida election officials and Electronic Systems & Software (ES&S) apparently misled a judge by claiming that there was no evidence that machine malfunction contributed to the loss of 18,000 votes in that race.

Judge Rejects Okeechobee School Board’s Attempt to Block Gay-Straight Alliance Anti-Discrimination Lawsuit (03/13/2007)
OKEECHOBEE, FL – The American Civil Liberties Union of Florida today applauded U.S. District Court Judge K. Michael Moore’s decision to deny the Okeechobee School Board’s motion to dismiss the case alleging discrimination against gay and straight students at Okeechobee High School.

ACLU of Florida and Amnesty International Call on Congress to Restore Habeas, Close Guantánamo (01/11/2007)
MIAMI, FL - On the fifth anniversary of the first known flight of prisoners to the U.S. prison in Guantánamo Bay, Cuba, the American Civil Liberties Union of Florida and Amnesty International are calling for restoration of habeas and due process rights as well as closure of the Guantánamo prison. The Military Commissions Act of 2006 gutted habeas - our law against unlawful imprisonment - from our Constitution, thus removing the limitations on arbitrary executive power over any person's individual freedoms.

Gay-Straight Alliance Seeks Injunction to Gain Equal Access at Okeechobee, Florida High School (01/11/2007)
OKEECHOBEE, FL - The American Civil Liberties Union of Florida today asked a federal court to order school officials to allow the Okeechobee Gay-Straight Alliance to start meeting. The motion seeks to grant the students access to meet on campus for the duration of the legal proceedings.

Florida Voters Join Emergency Petition for Access to Voting Machine Information (01/09/2007)
TALLAHASSEE, FL - Voters from Sarasota County who are contesting the election in Florida's 13th Congressional District joined and added to an emergency petition for review filed last Wednesday by candidate Christine Jennings in the First District Court of Appeals. The petition asks the higher court for expedited review of Leon Circuit Court Judge William L. Gary's December 29 order denying plaintiffs access to the e-voting hardware, software and source code used in November's election.

Hillsborough County Schools Keep Open-Door Policy for Gay-Straight Alliances (12/13/2006)
TAMPA, FL - Students, parents and community leaders today commended the Hillsborough County School Board for rejecting a proposal to turn away students from extracurricular activities if they do not have a permission slip.

MIAMI – The American Civil Liberties Union of Florida and its Greater Miami Chapter today sent a letter urging the Miami-Dade County Commission to amend a resolutions calling for voter-verified paper trails for touch-screen voting machines.

Sarasota Voters File Lawsuit for Revote in Congressional Race (11/21/2006)
TALLAHASSEE, FL - Voters from Sarasota County today filed a lawsuit in state court asking for a revote in Florida’s 13th Congressional district. The lawsuit alleges that thousands of voters were disenfranchised when massive undervotes plagued the tight Congressional race between Democrat Christine Jennings and Republican Vern Buchanan. In a high-profile battle over former Rep. Katherine Harris' seat, the result was decided by 363 votes, yet over 18,000 ballots cast on Sarasota County's e-voting machines registered no vote in the race, an exceptional anomaly in the State.

ACLU Sues to Enforce Equal Access for Gay-Straight Alliance at Okeechobee High School (11/15/2006)
OKEECHOBEE, FL – The American Civil Liberties Union of Florida today filed a lawsuit against the School Board of Okeechobee County after school district administrators unlawfully prevented students who formed the Gay-Straight Alliance of Okeechobee High School (GSA) to meet on high school grounds. School officials denied official recognition to the GSA even though many other extracurricular clubs – including the Fellowship of Christian Athletes, the Key Club, and the Rodeo team – are officially recognized and meet regularly on school grounds.

Abstinence-Only Sex Education May Endanger Youth in Leesburg, FL, ACLU Says (11/03/2006)
LEESBURG, FL -- The American Civil Liberties Union of Florida today expressed concern over the announcement that the Christian Care Center, a ministry of First Baptist of Leesburg, will use a $2 million federal grant to teach abstinence-only education to teens.

ACLU Urges Florida Candidates to Clarify Position on Restoration of Civil Rights (10/20/2006)
TALLAHASSEE, FL -- In a letter sent today to the two major party candidates for governor, the American Civil Liberties Union of Florida urged Attorney General Charlie Crist and Congressman Jim Davis to clarify their position on the restoration of civil and voting rights to former felons. The ACLU is asking the candidates to make it clear that they will use the authority of the governor to make a change in the system of lifetime disfranchisement.

ACLU Welcomes U.S. Department of Justice’s Support in Boca Raton Housing Discrimination Case (09/20/2006)
BOCA RATON, FL -- The U.S. Department of Justice filed a lawsuit in federal court today intervening in the city of Boca Raton’s unconstitutional discrimination against persons with disabilities. The American Civil Liberties Union of Florida’s Palm Beach Chapter, which filed suit on behalf of residents with disabilities in 2004, welcomed the DOJ’s support on this important civil liberties case.

ACLU of Florida, PRLDEF and Local Advocates Vow to Sue Over Palm Bay Anti-Immigrant Ordinance (08/15/2006)
PALM BAY, FL – The American Civil Liberties Union of Florida, the Florida Immigrant Advocacy Center, the Puerto Rican Legal Defense and Education Fund and the law firm of Weil, Gotshal & Manges today sent a letter to the City of Palm Bay expressing opposition to the anti-immigrant ordinances which are under consideration by the Palm Bay City Council. Should the Council vote to pass the ordinances, the organizations have vowed to challenge the laws in court on behalf of Palm Bay constituents.

Tampa Buccaneers Fans Free from Mass Random Searches (07/28/2006)
TAMPA, FL -- The American Civil Liberties Union of Florida today announced that a federal judge has blocked mass pat-down searches at Buccaneer games, stating that the public "has a compelling interest in preserving the constitutional right to be free from unreasonable governmental intrusion."

MIAMI, FL - The Florida Library Association supported a lawsuit filed by the American Civil Liberties Union of Florida and the Miami-Dade Student Government Association against the Miami-Dade County School Board for its removal of the book Vamos a Cuba and the book series "A Visit to..." from local libraries and classrooms, the ACLU announced today.

ACLU of Florida Sues Miami Officials for Blocking Human Rights Protest at Free Trade Meeting (06/27/2006)

ACLU of Florida Condemns New Law Limiting International Travel and Academic Research (06/02/2006)
MIAMI - Today, Gov. Jeb Bush signed SB 2434 (Relating to Travel to Terrorist States) into law. The measure hampers the academic study of countries that are vital to national security by prohibiting the use of state university and community college funding from being used for travel to “terrorist states.” The law applies to funding not only from the government but other sources as well.

In Landmark Florida Case, ACLU Preserves Right of Students Not to Recite Pledge (06/01/2006)
WEST PALM BEACH, FL -- The American Civil Liberties Union of Florida today applauded a district court ruling striking down a state law requiring students to stand and recite the Pledge of Allegiance. The pledge will continue to be recited in public school classrooms, but the unconstitutional practice of forcing all students to stand and recite the pledge will be halted.

FBI Targeted Journalist Covering Free Trade Meetings in Miami (05/04/2006)
MIAMI -- The American Civil Liberties Union, Greater Miami Chapter, filed a lawsuit today on behalf of a journalist who was under FBI surveillance because of his involvement in protests. The ACLU has obtained FBI documents showing that the FBI monitored freelance journalist David Lippman as he traveled from his home in North Carolina to Miami to cover the Free Trade Area of the Americas (FTAA) protests in 2003.
